Miguel Lopez International Lawyers has obtained a new favorable ruling from the Superior Court of Justice (TSJ) of Madrid in reference to a denial of a non-profit residence visa by the Spanish consulate in Algiers. Once again, the court upheld the appeal filed by our office, with a ruling favorable to a client of Algerian nationality who had been denied this visa due to economic criteria.

In this way, the TSJ of Madrid, which is the competent court to settle judicial questions regarding Spanish consulates abroad, once again agrees with Miguel López International Lawyers and rules against the criteria that the consulate in Algiers was applying. This criterion consisted of computing in the applicant's financial requirements only creditable periodic income. And other assets, especially saved bank balances, were excluded from the calculation.

The Madrid Supreme Court has agreed with ML International Lawyers, considering that the accreditation of bank balances is sufficient to comply with the economic requirement that Algerian applicants are asked for a non-profit residence visa in Spain. This office has already presented several appeals by Algerian citizens for visa denials based on the same assessment of economic requirements. And this is the third favorable sentence that is obtained consecutively, trusting that the same result will be obtained for those that are still pending resolution.

In fact, the Consulate in Algiers seems to have already abandoned the criterion of computing only periodic income as economic means, although it continues to deny visas based on arguments that we understand are also actionable in court.
